ASSUMPTION OF RISK, RELEASE, AND
WAIVER OF LIABILITY

OCCS – December 13, 2025 – Santa Ana, Orange County, CA

By RSVPing to attend, accepting an invitation for, and/or attending the event hosted by OCCS on December 13, 2025, in Santa Ana, Orange County, California (the “Event”), you (“Guest”) acknowledge and agree to the following:

1. Voluntary Participation

   I understand that my attendance at the Event is voluntary and may involve certain inherent risks, including but not limited to injury, illness (including communicable diseases such as COVID-19), property damage, emotional distress, or other unforeseen hazards.

2. Assumption of Risk

   I knowingly and freely assume all risks, whether known or unknown, including those arising out of the negligence of OCCS or any of the Released Parties (defined below), other guests, performers, vendors, contractors, or third parties.

3. Release of Liability

   To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless OCCS and its parents, subsidiaries, affiliates, officers, directors, employees, contractors, vendors, agents, venue owners, security personnel, performers, sponsors, guests, and invitees (collectively, the “Released Parties”) from any and all claims, actions, causes of action, damages, losses, liabilities, injuries, costs, or expenses (including attorneys’ fees) arising out of or related to my presence at or participation in the Event.

   This includes any claims related to negligence, premises liability, personal injury, property damage, privacy, or right of publicity.

   This release also applies to all activities surrounding the Event, including ingress/egress, transportation, filming, after-parties, activations, and any related events.

4. Indemnification

   I agree to defend, indemnify, and hold harmless the Released Parties from and against all claims, damages, losses, liabilities, and expenses (including attorneys’ fees) arising out of:

   • My acts or omissions;
   • My violation of any rules or laws;
   • My breach of this waiver;
   • Any third-party claim related to my conduct.

5. Alcohol, Substances & Behavior

   I understand alcohol may be served. I am solely responsible for my consumption, behavior, and transportation.

   • Illegal drugs are prohibited.
   • The Released Parties may remove any individual for unsafe, disorderly, or illegal behavior.
   • I am responsible for any damage I cause.

6. Weapons / Dangerous Items

   Weapons, fireworks, and hazardous items are prohibited. The Released Parties may search belongings or deny entry at their discretion.

7. Medical Treatment

   In case of illness or emergency, I authorize the Released Parties to obtain medical treatment. I release them from any claims related to such treatment and agree that I am responsible for any resulting costs.

8. Photography, Video & Media Rights

   I acknowledge the Event will be recorded and photographed. I irrevocably grant the Released Parties the unrestricted right to capture, use, publish, distribute, edit, modify, or exploit my image, voice, name, and likeness in any media, worldwide, in perpetuity, for any purpose, without compensation or approval.

   I waive any rights of privacy, publicity, or inspection.

9. No Expectation of Privacy

   I understand that this is a public event where recording and posting may occur. I have no expectation of privacy except within designated restrooms.

10. Communications & Marketing Consent

    By accepting this waiver, I consent to OCCS and its affiliates using the contact information I provide—including but not limited to my phone number, email, and/or Instagram handle—to send communications related to events, updates, promotions, and general notifications via text message, email, and/or Instagram direct message.

    I understand I may opt out at any time through the provided channels.

11. Personal Property

    I am solely responsible for my personal belongings. The Released Parties are not liable for lost, stolen, or damaged property.

12. Third-Party Vendors / Performers

    I understand third-party vendors, sponsors, or performers may operate at the Event. The Released Parties are not responsible for their acts, omissions, products, or services, and I release all related claims.

13. Compliance with Rules, Laws & Directions

    I agree to follow all Event rules, signage, instructions from staff and security, and all local, state, and federal laws. Violations may result in removal without refund.

14. Force Majeure / Event Changes

    The Released Parties may cancel, postpone, or modify the Event due to weather, safety issues, legal restrictions, or other circumstances beyond their control. No refunds or damages shall be owed.

15. Governing Law & Dispute Resolution

    This waiver is governed by California law. Any dispute must be brought exclusively in the state or federal courts of Orange County, California, and I waive any objection to that venue.

16. Severability

    If any part of this waiver is found unenforceable, the remaining provisions remain fully effective.

17. Acknowledgment of Terms

    By RSVPing, accepting an invitation, entering the venue, and/or attending the Event, I affirm that:

    • I have read and understand this waiver;
    • I am at least 21 years of age;
    • I voluntarily agree to be legally bound;
    • I understand I am waiving substantial legal rights, including the right to sue.
